Toward better buy ways

For sixteen years, ProjectVRM has encouraged the development of tools and services that solve business problems from the customer side. This work is toward testing a theory: that free customers are more valuable—to themselves and to the businesses they engage—than captive ones. That theory can only be tested when tools for doing that are in place.

We already have some of those tools. Our big four in the digital world are the browser, the phone, email, and texting. In the analog offline world, our best model is cash. From The Cash Model of Customer Experience:

Here’s the handy thing about cash: it gives customers scale. It does that by working the same way for everybody, everywhere it’s accepted. It’s also anonymous by nature, meaning it carries no personal identifiers. Recording what happens with it is also optional, because using it doesn’t require an entry in a ledger (as happens with cryptocurrencies). Cash has also been working this way for thousands of years. But we almost never talk about our “experience” with cash, because we don’t need to.

The problem with our four personal digital tools—browser, phone, email and texting—is that they are not fully ours. So our agency is at best compromised. Specifically,

  1. The most popular browsers are also agents of Apple, Google, Microsoft, plus countless thousands of third parties inserting cookies and other tracking instruments into our devices.
  2. Our phones are not just ours. They are corporate tentacles of Apple and Google, lined with countless personal data suction cups from unknown surveillance systems. (For more on this, see Apple vs (or plus) Adtech, Part I and Part II.)
  3. Apple and Google together supply 87% of all email software and services. Apple promises privacy, while Google makes a business out of knowing the contents of your messages, plus every other Google-provided or -involved piece of software reveals to the company about your life. As for how well Apple delivers on its privacy promises, look up apple+compromised+privacy.
  4. The original messaging service for phones, SMS, is owned and run by phone companies. Other major messaging, texting and chat services are run entirely by private companies.
  5. Among common Internet activities, only email and browsing are based on open and simple standards. The main ones are SMTP, IMAP, and POP3 for email, and HTTP/S for browsing. Those share the Internet’s three NEA virtues: Nobody owns them, Everybody can use them, and Anybody can improve them.

This is important: If a product or service mostly works for some company, it’s not yours. You are a user or a consumer. You are not a customer; nor are you operating with full agency in a truly free market. So, while it is obvious that all of us are made more valuable to business, and to ourselves, because we use browsers, phones, email, and messaging, we can’t say that we are free while we do.

But the Internet is still young: dating in its current form—supportive of e-commerce—since 30 April 1995, when the NSFNET (one of the Internet’s backbones) was decommissioned, and its policy forbidding commercial traffic on its pipes no longer stood in the way. The Net will also be with us for dozens or hundreds of decades to come, with its base protocol, TCP/IP, continuing to support freedom for every node on it.

More importantly, there are many business problems best or only solved from the customer side. Here is a list:

  1. Identity. Logins and passwords are burdensome leftovers from the last millennium. There should be (and already are) better ways to identify ourselves by revealing to others only what we need them to know. Working on this challenge is the SSI—Self-Sovereign Identity—movement.  (Which also goes by many other names. The latest is Web5.) The solution here for individuals is tools of their own that scale. Note that there is a LOT happening here. One good way keep up with it is in the Identisphere newsletter.  You can also participate by attending the twice-yearly Internet Identity Workshop, which has been going strong since 2005.
  2. Subscriptions. Nearly all subscriptions are pains in the butt. “Deals” can be deceiving, full of conditions and changes that come without warning. New customers often get better deals than loyal customers. And there are no standard ways for customers to keep track of when subscriptions run out, need renewal, or change. The only way this can be normalized is from the customers’ side.
  3. Terms and conditions. In the world today, nearly all of these are ones that companies proffer; and we have little or no choice about agreeing to them. Worse, in nearly all cases, the record of agreement is on the company’s side. Oh, and since the GDPR came along in Europe and the CCPA in California, entering a website has turned into an ordeal typically requiring “consent” to privacy violations the laws were meant to stop. Or worse, agreeing that a site or a service provider spying on us is a “legitimate interest.” The solution here is terms individuals can proffer and organizations can agree to. The first of these is #NoStalking, and allows a publisher to do all the advertising they want, so long as it’s not based on tracking people. Think of it as the opposite of an ad blocker. (Customer Commons is also involved in the IEEE’s P7012 Standard for Machine Readable Personal Privacy Terms.
  4. Payments. For demand and supply to be truly balanced, and for customers to operate at full agency in an open marketplace (which the Internet was designed to support), customers should have their own pricing gun: a way to signal—and actually pay willing sellers—as much as they like, however, they like, for whatever they like, on their own terms. There is already a design for that, called EmanciPay. Its promise for the music industry alone is enormous.
  5. Intentcasting. Advertising is all guesswork, which involves massive waste. But what if customers could safely and securely advertise what they want, and only to qualified and ready sellers? This is called intentcasting, and to some degree, it already exists. Toward this, the Intention Byway is a core focus of Customer Commons.   6. Shopping. Why can’t you have your own shopping cart—that you can take from store to store? Because we haven’t invented one yet. But we can. And when we do, all sellers are likely to enjoy more sales than they get with the current system of all-silo’d carts.
  7. Internet of Things. We don’t have this yet. Instead, we have the Apple of things, the Amazon of things, the Google of things, the Samsung of things, the Sonos of things, and so on, each silo’d in separate systems we don’t control. Things we own on the Internet should be our things. We should be able to control them, as independent operators, as we do with our computers and mobile devices. (Also, by the way, things don’t need to be intelligent or connected to belong to the Internet for us to control what’s known about them. They can be, or have, picos.)
  8. Loyalty. All loyalty programs are gimmicks, and coercive. True loyalty is worth far more to companies than the coerced kind, and only customers are in a position to truly and fully express it. We should have our own loyalty programs, to which companies are members, rather than the reverse.
  9. Privacy. We’ve had privacy tech in the physical world since the inventions of clothing, shelter, locks, doors, shades, shutters, and other ways to limit what others can see or hear—and to signal to others what’s okay and what’s not. Instead, all we have are unenforced promises by others not to watch our naked selves, or to report what they see to others. Or worse, coerced urgings to “accept” spying on us and distributing harvested information about us to parties unknown, with no record of what we’ve agreed to.
  10. Customer service. There are no standard ways for customers and companies to enjoy relationships, with useful data flowing both ways, and for help to come when it’s needed. Instead, every company does it differently, in its own silo’d system. For more on this, see # 12 below.
  11. Regulatory compliance. Especially around privacy. Because really, all the GDPR and the CCPA want is for companies to stop spying on people. Without any privacy tech on the individual’s side, however, responsibility for everyone’s privacy is entirely a corporate burden. This is unfair to people and companies alike, as well as insane—because it can’t work. (Worse, nearly all B2B “compliance” solutions only solve the felt need by companies to obey the letter of a law while ignoring its spirit. But if people have their own ways to signal their privacy requirements and expectations (as they do with clothing and shelter in the natural world), life gets a lot easier for everybody, because there’s something there to respect. We don’t have that yet online, but it shouldn’t be hard. For more on this, see Privacy is Personal and our own Privacy Manifesto.
  12. Real relationships: ones in which both parties actually care about and help each other, and good market intelligence flows both ways. Marketing by itself can’t do it. All you get is the sound of one hand slapping. (Or, more typically, pleasuring itself with mountains of data and fanciful maths first described in Darrell Huff’s How to Lie With Statistics, written in 1954). Sales departments can’t do it either, because their job is done once the relationship is established. CRM can’t do it without a VRM hand to shake on the customer’s side. From What Makes a Good Customer: “Consider the fact that a customer’s experience with a product or service is far more rich, persistent and informative than is the company’s experience selling those things, or learning about their use only through customer service calls (or even through pre-installed surveillance systems such as those which for years now have been coming in new cars). The curb weight of customer intelligence (knowledge, know-how, experience) with a company’s products and services far outweighs whatever the company can know or guess at. So, what if that intelligence were to be made available by the customer, independently, and in standard ways that work at scale across many or all of the companies the customer deals with?”
  13. Any-to-any/many-to-many business: a market environment where anybody can easily do business with anybody else, mostly free of centralizers or controlling intermediaries (with due respect for inevitable tendencies toward federation). There is some movement in this direction around what’s being called Web3.
  14. Life management platforms. KuppingerCole has been writing and thinking about these since not long after they gave ProjectVRM an award for its work, way back in 2007. These have gone by many labels: personal data clouds, vaults, dashboards, cockpits, lockers, and other ways of characterizing personal control of one’s life where it meets and interacts with the digital world. The personal data that matters in these is the kind that matters in one’s life: health (e.g. HIEofOne), finances, property, subscriptions, contacts, calendar, creative works, and so on, including personal archives for all of it. Social data out in the world also matters, but is not the place to start, because that data is less important than the kinds of personal data listed above—most of which has no business being sold or given away for goodies from marketers. All of these, however, are ocean-boiling ideas. In other words, not easy, especially without what the military calls “robust funding.” So our strategies are best aimed toward what are called “blue” rather than “red” (blood filled) oceans. One of those is the Byway (or “buyway”) project by Customer Commons, in Bloomington, Indiana. An excerpt:

There are three parts to the Byway project as it now stands (in July 2022): an online community (Small Town/mastodon), a matcher tool (Intently), and a local e-commerce “buyway.” (For more on that one, download the slide deck presented by Doc and Joyce at The Mill in November 2021. We also see the Byway as complementary to, rather than competitive with, developments with similar and overlapping ambitions, such as SSI, DIDcomm, picos, JLINC, Digital Homesteading / Dazzle and many others.

Joyce and I, both founders and board members of Customer Commons, are heading up to DWeb Camp in a few minutes, and plan to make progress there on Byway development. I’ll report here on progress.

Is being less tasty vegetables our best strategy?

That’s a vivid way to put the problem.

There are many approaches to solutions as well. One is suggested today in the latest by @_KarenHao in MIT Technology Review, titled

How to poison the data that Big Tech uses to surveil you:
Algorithms are meaningless without good data. The public can exploit that to demand change.

An  excerpt:

In a new paper being presented at the Association for Computing Machinery’s Fairness, Accountability, and Transparency conference next week, researchers including PhD students Nicholas Vincent and Hanlin Li propose three ways the public can exploit this to their advantage:
Data strikes, inspired by the idea of labor strikes, which involve withholding or deleting your data so a tech firm cannot use it—leaving a platform or installing privacy tools, for instance.
Data poisoning, which involves contributing meaningless or harmful data. AdNauseam, for example, is a browser extension that clicks on every single ad served to you, thus confusing Google’s ad-targeting algorithms.
Conscious data contribution, which involves giving meaningful data to the competitor of a platform you want to protest, such as by uploading your Facebook photos to Tumblr instead.
People already use many of these tactics to protect their own privacy. If you’ve ever used an ad blocker or another browser extension that modifies your search results to exclude certain websites, you’ve engaged in data striking and reclaimed some agency over the use of your data. But as Hill found, sporadic individual actions like these don’t do much to get tech giants to change their behaviors.
What if millions of people were to coordinate to poison a tech giant’s data well, though? That might just give them some leverage to assert their demands.

The sourced paper* is titled Data Leverage: A Framework for Empowering the Public in its Relationship with Technology Companies, and concludes,

In this paper, we presented a framework for using “data leverage” to give the public more influence over technology company behavior. Drawing on a variety of research areas, we described and assessed the “data levers” available to the public. We highlighted key areas where researchers and policymakers can amplify data leverage and work to ensure data leverage distributes power more broadly than is the case in the status quo.

I am all for screwing with overlords, and the authors suggest some fun approaches. Hell, we should all be doing whatever it takes, lawfully (and there is a lot of easement around that) to stop rampant violation of our privacy—and not just by technology companies. The customers of those companies, which include every website that puts up a cookie notice that nudges visitors into agreeing to be tracked all over the Web (in observance of the letter of the GDPR, while screwing its spirit), are also deserving of corrective measures. Same goes for governments who harvest private data themselves, or gather it from others without our knowledge or permission.

My problem with the framing of the paper and the story is that both start with the assumption that we are all so weak and disadvantaged that our only choices are: 1) to screw with the status quo to reduce its harms; and 2) to seek relief from policymakers.  While those choices are good, they are hardly the only ones.

Some context: wanton privacy violations in our digital world has only been going on for a little more than a decade, and that world is itself barely more than  a couple dozen years old (dating from the appearance of e-commerce in 1995). We will also remain digital as well as physical beings for the next few decades or centuries.

So we need more than these kinds of prescriptive solutions. For example, real privacy tech of our own, that starts with giving us the digital versions of the privacy protections we have enjoyed in the physical world for millennia: clothing, shelter, doors with locks, and windows with curtains or shutters.

We have been on that case with ProjectVRM since 2006, and there are many developments in progress. Some even comport with our Privacy Manifesto (a work in progress that welcomes improvement).

As we work on those, and think about throwing spanners into the works of overlords, it may also help to bear in mind one of Craig Burton‘s aphorisms: “Resistance creates existence.” What he means is that you can give strength to an opponent by fighting it directly. He applied that advice in the ’80s at Novell by embracing 3Com, Microsoft and other market opponents, inventing approaches that marginalized or obsolesced their businesses.

I doubt that will happen in this case. Resisting privacy violations has already had lots of positive results. But we do have a looong way to go.

Personal scale

Way back in 1995, when our family was still new to the Web, my wife asked a question that is one of the big reasons I started ProjectVRM: Why can’t I take my own shopping cart from one site to another?

The bad but true answer is that every site wants you to use their shopping cart. The good but not-yet-true answer is that nobody has invented it yet. By that I mean: not  a truly personal one, based on open standards that make it possible for lots of developers to compete at making the best personal shopping cart for you.

Think about what you might be able to do with a PSC (Personal Shopping Cart) online that you can’t do with a physical one offline:

  • Take it from store to store, just as you do with your browser. This should go without saying, but it’s still worth repeating, because it would be way cool.
  • Have a list of everything parked already in your carts within each store.
  • Know what prices have changed, or are about to change, for the products in your carts in each store.
  • Notify every retailer you trust that you intend to buy X, Y or Z, with restrictions (meaning your terms and conditions) on the use of that information, and in a way that will let you know if those restrictions are violated. This is called intentcasting, and there are a pile of companies already in that business.
  • Have a way to change your name and other contact information, for all the stores you deal with, in one move.
  • Control your subscriptions to each store’s emailings and promotional materials.
  • Have your  own way to express genuine loyalty , rather than suffering with as many coercive and goofy “loyalty programs” as there are companies
  • Have a standard way to share your experiences with the companies that make and sell the products you’ve bought, and to suggest improvements—and for those companies to share back updates and improvements you should know about.
  • Have wallets of your own, rather than only those provided by platforms.
  • Connect to your collection of receipts, instruction manuals and other relevant information for all the stuff you’ve already bought or currently rent. (Note that this collection is for the Internet of your things—one you control for yourself, and is not a set of suction cups on corporate tentacles.)
  • Your own standard way to call for service or support, for stuff you’ve bought or rented, rather than suffering with as many different ways to do that as there are companies you’ve engaged

All of these things are Me2B, and will give each of us scale, much as the standards that make the Internet, browsers and email all give us scale. And that scale will be just as good for the companies we deal with as are the Internet, browsers and email.

If you think “none of the stores out there will want any of this, because they won’t control it,” think about what personal operating systems and browsers on every device have already done for stores by making the customer interface standard. What we’re talking about here is enlarging that interface.

I’d love to see if there is any economics research and/or scholarship on personal scale and its leverage (such as personal operating systems, devices and browsers give us) in the digital world). Because it’s a case that needs to be made.

Of course, there’s money to me made as well, because there will be so many more, better and standard ways for companies to deal with customers than current tools (including email, apps and browsers) can by themselves.

Services that rely on consumers granting access to their financial records include:

  • Budgeting analysis and advice:  Some tools let people set budgets and analyze their spending activity.  The tools organize your purchases across multiple accounts into categories like food, health care, and entertainment so you can see trends. Some services send a text or email notification when a spending category is close to being over-budget.

  • Product recommendations: Some tools may make recommendations for new financial products based on your financial history. For example, if your records show that you have a lot of ATM fees, a tool might recommend other checking accounts with lower or no ATM fees.

  • Account verification: Many companies need you to verify your identity and bank account information. Access to your financial records can speed that process.

  • Loan applications: Some lenders may access your financial records to confirm your income and other information on your loan application.

  • Automatic or motivational savings: Some companies analyze your records to provide you with automatic savings programs and messages to keep you motivated to save.

  • Bill payment: Some services may collect your bills and help you organize your payments in a timely manner.

  • Fraud and identity theft protection: Some services analyze your records across various accounts to alert you about potentially fraudulent transactions.

  • Investment management: Some services use your account records to help you manage your investments.

Our job is to put consumers first and help them take more control over their financial lives. We’re the one federal agency with the sole mission of protecting consumers in the financial marketplace. We want to make sure that consumer financial products and services are helping people rather than harming them.

VRM Day: Starting Phase Two

VRM Day is today, 24 October, at the Computer History Museum. IIW follows, over the next three days at the same place. (The original version of this post was October 17.)

We’ve been doing VRM Days since (let’s see…) this one in 2013, and VRM events since this one in 2007. Coming on our tenth anniversary, this is our last in Phase One.

sisyphusTheRolling snowball difference between Phase One and Phase Two is that between rocks and snowballs. In Phase One we played Sisyphus, pushing a rock uphill. In Phase Two we roll snowballs downhill.

Phase One was about getting us to the point where VRM was accepted by many as a thing bound to happen. This has taken ten years, but we are there.

Phase Two is about making it happen, by betting our energies on ideas and work that starts rolling downhill and gaining size and momentum.

Some of that work is already rolling. Some is poised to start. Both kinds will be on the table at VRM Day. Here are ones currently on the agenda:

  • VRM + CRM via JLINC. See At last: a protocol to link VRM and CRM. , and The new frontier for CRM is CDL: customer driven leads. This is a one form of intentcasting that should be enormously appealing to CRM companies and their B2B corporate customers. Speaking of which, we also have—
  • Big companies welcoming VRM.  Leading this is Fing, a French think tank that brings together many of the country’s largest companies, both to welcome VRM and to research (e.g. through Mesinfos) how the future might play out. Sarah Medjek of Fing will present that work, and lead discussion of where it will head next. We will also get a chance to participate in that research by providing her with our own use cases for VRM. (We’ll take out a few minutes to each fill out an online form.)
  • Terms individuals assert in dealings with companies. These are required for countless purposes. Mary Hodder will lead discussion of terms currently being developed at Customer Commons and the CISWG / Kantara User Submitted Terms working group (Consent and Information Sharing Working Group). Among other things, this leads to—
  • 2016_04_25_vrmday_000-1Next steps in tracking protection and ad blocking. At the last VRM Day and IIW, we discussed CHEDDAR on the server side and #NoStalking on the individual’s side. There are now huge opportunities with both, especially if we can normalize #NoStalking terms for all tracking protection and ad blocking tools.  To prep for this, see  Why #NoStalking is a good deal for publishers, where you’ll find the image on the right, copied from the whiteboard on VRM Day.
  • Blockchain, Identity and VRM. Read what Phil Windley has been writing lately distributed ledgers (e.g. blockchain) and what they bring to the identity discussions that have been happening for 22 IIWs, so far. There are many relevancies to VRM.
  • Personal data. This was the main topic at two recent big events in Europe: MyData2016 in Helsinki and PIE (peronal information economy) 2016 in London.  The long-standing anchor for discussions and work on the topic at VRM Day and IIW is PDEC (Personal Data Ecosystem Consortium). Dean Landsman of PDEC will keep that conversational ball rolling. Adrian Gropper will also brief us on recent developments around personal health data as well.
  • Hacks on the financial system. Kevin Cox can’t make it, but wants me to share what he would have presented. Three links: 1) a one minute video that shows why the financial system is so expensive, 2) part of a blog post respecting his local Water Authority and newly elected government., and 3) an explanation of the idea of how we can build low-cost systems of interacting agents. He adds, “Note the progression from location, to address, to identity, to money, to housing.  They are all ‘the same’.” We will also look at how small business and individuals have more in common than either do with big business. With a hint toward that, see what Xero (the very hot small business accounting software company) says here.
  • What ProjectVRM becomes. We’ve been a Berkman-Klein Center project from the start. We’ve already spun off Customer Commons. Inevitably, ProjectVRM will itself be spun off, or evolve in some TBD way. We need to co-think and co-plan how that will go. It will certainly live on in the DNA of VRM and VRooMy work of many kinds. How and where it lives on organizationally is an open question we’ll need to answer.

Here is a straw man context for all of those and more.

  • Top Level: Tools for people. These are ones which, in legal terms, give individuals power as first parties. In mathematical terms, they make us independent variables, rather than dependent ones. Our focus from the start has been independence and engagement.
    • VRM in the literal sense: whatever engages companies’ CRM or equivalent systems.
    • Intentcasting.
    • PIMS—Personal Information Management Systems. Goes by many names: personal clouds, personal data stores, life management platforms and so on. Ctrl-Shift has done a good job of branding PIMS, however. We should all just go with that.
    • Privacy tools. Such as those provided by tracking protection (and tracking-protective ad blocking).
    • Legal tools. Such as the terms Customer Commons and the CISWG are working on.
    • UI elements. Such as the r-button.
    • Transaction & payment systems. Such as EmanciPay.

Those overlap to some degree. For example, a PIMS app and data store can do all that stuff. But we do need to pull the concerns and categories apart as much as we can, just so we can talk about them.

We’re done with Phase One

That’s Sean Bohan, head of our steering committee, expanding on what many people at the conference already knew.

I was there too, giving the morning keynote on Day 2:

It was an entirely new talk. Pretty good one too, especially since  I came up with it the night before.

See, by the end of Day 1, it was clear that pretty much everybody at the conference already knew how market power was shifting from centralized industries to distributed individuals and groups (including many inside centralized industries). It was also clear that most of the hundreds of people at the conference were also familiar with VRM as a market category. I didn’t need to talk about that stuff any more. At least not in Europe, where most of the VRM action is.

So, after a very long journey, we’re finally getting started.

In my own case, the journey began when I saw the Internet coming, back in the ’80s.  It was clear to me that the Net would change the world radically, once it allowed commercial activity to flow over its pipes. That floodgate opened on April 30, 1995. Not long after that, I joined the fray as an editor for Linux Journal (where I still am, by the way, more than 20 years later). Then, in 1999, I co-wrote The Cluetrain Manifesto, which delivered this “one clue” above its list of 95 Theses:

And then, one decade ago last month, I started ProjectVRM, because that clue wasn’t yet true. Our reach did not exceed the grasp of marketers in the world. If anything, the Net extended marketers’ grasp a lot more than it did ours. (Shoshana Zuboff says their grasp has metastacized into surveillance capitalism. ) In respect to Gibson’s Law, Cluetrain proclaimed an arrived future that was not yet distributed. Our job was to distribute it.

Which we have. And we can start to see results such as those above. So let’s call Phase One a done thing. And start thinking about Phase Two, whatever it will be.

To get that work rolling, here are a few summary facts about ProjectVRM and related efforts.

First, the project itself could hardly be more lightweight, at least administratively. It consists of:

Second, we have a spin-off: Customer Commons, which will do for personal terms of engagement (one each of us can assert online) what Creative Commons (another Berkman-Klein spinoff) did for copyright.

Third, we have a list of many dozens of developers, which seem to be concentrated in Europe and Australia/New Zealand.  Two reasons for that, both speculative:

  1. Privacy. The concept is much more highly sensitive and evolved in Europe than in the U.S. The reason we most often get goes, “Some of our governments once kept detailed records of people, and those records were used to track down and kill many of them.” There are also more evolved laws respecting privacy. In Australia there have been privacy laws for several years requiring those collecting data about individuals to make it available to them, in forms the individual specifies. And in Europe there is the General Data Protection Regulation, which will impose severe penalties for unwelcome data gathering from individuals, starting in 2018.
  2. Enlightened investment. Meaning investors who want a startup to make a positive difference in the world, and not just give them a unicorn to ride out some exit. (Which seems to have become the default model in the U.S., especially Silicon Valley.)

What we lack is research. And by we I mean the world, and not just ProjectVRM.

Research is normally the first duty of a project at the Berkman Klein Center, which is chartered as a research organization. Research was ProjectVRM’s last duty, however, because we had nothing to research at first. Or, frankly, until now. That’s why we were defined as a development & research project rather than the reverse.

Where and how research on VRM and related efforts happens is a wide open question. What matters is that it needs to be done, starting soon, while the “before” state still prevails in most of the world, and the future is still on its way in delivery trucks. Who does that research matters far less than the research itself.

So we are poised at a transitional point now. Let the conversations about Phase Two commence.

Preparing for the 3D/VR future

Look in the direction that meerkatMeerkat and periscopeappPeriscope both point.

If you’ve witnessed the output of either, several things become clear about their evolutionary path:

  1. Stereo sound is coming. So is binaural sound, with its you-are-there qualities.
  2. 3D will come too, of course, especially as mobile devices start to include two microphones and two cameras.
  3. The end state of both those developments is VR, or virtual reality. At least on the receiving end.

The production end is a different animal. Or herd of animals, eventually. Expect professional gear from all the usual sources, showing up at CES starting next year and on store shelves shortly thereafter. Walking around like a dork holding a mobile in front of you will look in 2018 like holding a dial-phone handset to your head looks today.

I expect the most handy way to produce 3D and VR streams will be with  glasses like these:

Now pause to dig @ctrlzee‘s Fast Company report on Facebook’s 10-year plan to trap us inside The Matrix. How long before Facebook buys Meerkat and builds it into Occulus Rift? Or buys Twitter, just to get Periscope and do the same?

Whatever else happens, the rights clearing question gets very personal. Do you want to be broadcast and/or recorded by others or not? What are the social and device protocols for that? (The VRM dev community has designed one for the glasses above. See the ⊂ ⊃ in the glasses? That’s one. Each corner light is another.)

We should start zero-basing the answers today, while the inevitable is in sight but isn’t here yet. Empathy is the first requirement. (Take the time to dig Dave Winer’s 12-minute podcast on the topic. It matters.) Getting permission is another.

As for the relevance of standing law, almost none of it applies at the technical level. Simply put, all copyright laws were created in times when digital life was unimaginable (e.g. Stature of Anne, ASCAP), barely known (Act of 1976), or highly feared (WIPO, CTEA, DMCA).

How would we write new laws for an age that has barely started? Or why start with laws at all? (Nearly all regulation protects yesterday from last Thursday. And too often its crafted by know-nothings.)

We’ve only been living the networked life since graphical browsers and ISPs arrived in the mid-90’s. Meanwhile we’ve had thousands of years to develop civilization in the physical world. Which means that, relatively speaking, networked life is Eden. It’s brand new here, and we’re all naked. That’s why it’s so easy anybody to see everything about us online.

How will we create the digital equivalents of the privacy technologies we call clothing and shelter? Is the first answer a technical one, a policy one, or both? Which should come first? (In Europe and Australia, policy already has.)

Protecting the need for artists to make money is part of the picture. But it’s not the only part. And laws are only one way to protect artists, or anybody.

Manners come first, and we barely have those yet, if at all. None of the big companies that currently dominate our digital lives have fully thought out how to protect anybody’s privacy. Those that come closest are ones we pay directly, and are financially accountable to us.

Apple, for example, is doing more and more to isolate personal data to spaces the individual controls and the company can’t see. Google and Facebook both seem to regard personal privacy as a bug in online life, rather than a feature of it. (Note that, at least for their most popular services, we pay those two companies nothing. We are mere consumers whose lives are sold to the company’s actual customers, which are advertisers.)

Bottom line: the legal slate is covered in chalk, but the technical one is close to clean. What do we want to write there?

Designing the VRM future at IIW

A veteran VRooMeriiwxx tells me a design fiction would be a fun challenge for VRM Day and IIW (which will run from April 6-9 at the Computer History Museum in Mountain View, CA).

He describes one as “basically a way of peeking into the near future by demonstrating an imaginary product that doesn’t exist, but could. For example, instead of talking about a possible VRM product, one instead would create a marketing brochure, screen mockups or a fake video advertisement for this imaginary product as a way to help others understand where the world is headed and possibly even further the underlying technologies or driving concepts.”

Coincidentally, the subject of VRM Day (and a focus for the three days that will follow at IIW) is a maturity model framework that will provide every VRM developer the same single sheet (or set of them) on which to show where they stand in developing VRM capabilities into their company, product, code base or whatever else they’re working on. Work has already started on it, and those doing the work will present a first draft of it on VRM Day.

You know the old saying, “all singing from the same song sheet”? The VRM maturity model framework is it. Think of it as a musical score that is starting to be written, for an orchestra will come together. When we’re done with this round, we’ll at least know what the score describes, and give the players of different instruments enough of a framework so they know where they, and everybody else, fits.

By the end of IIW, it should be ready to do several things:

  1. Provide analysts with a single framework for understanding all VRM developers and development, and the coherencies among them.
  2. Give VRM developers a way to see how their work complements and/or competes with other VRM work that’s going on — and guide future developments.
  3. Give each developer a document to use for their own internal and external purposes.
  4. Give CRM, CE. CX and other vendor-side systems a clear picture of what pieces in the VRM development community will connect with their systems, and how, so buyer-side and seller-side systems can finally connect and grow together.

While we do this, it might also be fun to work out a design fiction as a summary document or video. What would the complete VRM solution (which will surely be a collection of them) look like? How would we present it as a single thing?

All of this is food for thinking and re-thinking. Suggestions invited.

The second coming of double-entry bookkeeping

Many years ago, in a column about journalism, William Safire surfaced a tasty bit of inside jargon: the word “MEGO.” It stood for “My Eyes Glaze Over.” Any story that was too important not to run but too dull to interest anybody was a MEGO. His example of a one-word MEGO was “eurodollars.”

Lately a three-word MEGO has come up in conversations about VRM (itself, admittedly, a MEGO): double-entry bookkeeping.  As it happens I have some source material for those conversations, in the form of a chapter of The Intention Economy that didn’t make it into the book because, well, it was a MEGO.

It’s still too important not to write about, however, even if it is too dull to interest more than a few people for a few minutes at a time. And hell, that’s why we have blogs, no?

What makes double-entry bookkeeping important is that maybe it can save our asses from what computing did to our hands-on knowledge of how business works—or ought to work—in a  hearty economy. Hence the hope behind the headline above.

So, rather than let my last draft of the chapter languish on my hard drive for another few years, here it is.

THE ARGUMENT

Networked markets connect two ways: between businesses and people, and between the functional parts of companies. These connections have long been facilitated through double-entry bookkeeping, the deep virtues of which have mostly been ignored or forgotten in our digital age. If we recall what double-entry bookkeeping did, and can do again, we may have another useful path toward The Intention Economy.

THE ORIGINAL BUSINESS SCIENCE

Modern banking is seven hundred years old. It was invented in early Renaissance Italy, and modeled at its start by the Medici bank, which lasted from 1397 to 1494.[ii] One fo those early Italian banks, Banca Monte dei Paschi di Siena S.p.A., founded in 1472, is still around.

Modern double-entry bookkeeping was also established in that time, though it dates back farther. The first major published work on the subject was Summa de arithmetica, geometria, proportioni et proportionalita (Venice: 1474), a textbook by Fra Luca Pacioli, a Franciscan monk, doctor of divinity, and mathematician on the faculty of several universities [iii]. Within Summa is a Tractatus de Computis et Scripturis: the first complete description of double-entry bookkeeping, a system of mathematics which Pacioli treats as equal to Euclid’s in relevance to the everyday world.

Summa was Pacioli’s second published work. Da_Vinci_Vitruve_bw-imagonlyThe first, Tractatus mathematicus ad discipulos perusinos, is a six hundred page textbook in which sixteen sections are devoted to “merchant arithmetic.” [iv] In 1509, Pacioli published both Geometry (a Latin translation of Euclid’s Elements) and Divina proportione, illustrated with sixty drawings by Pacioli’s student and friend, Leonardo da Vinci [1]. Although Pacioli and Leonardo did not begin working together until 1496, it is likely that da Vinci’s Vitruvian Man (on the right), drawn in 1487, was informed by Summa de arithmetica, a copy of which da Vinci possessed.[v] (Pacioli also applied the divine proportion (better known as the golden ratio) to typeface design. The “M” in the Metropolitan Museum of Art logo is Pacioli’s[vi])

In The Printing press as an agent for changeElizabeth Eisenstein calls Pacioli “a pioneering public lecturer and science-writer whose work was ransacked by others for a century or more”[vii], and “probably the most wide-ranging, influential and forceful advocate of mathematics for the layman during the first century of print,”[viii] with influences on DürerKeplerPascal and others. She continues,

Less often noted is the way this fifteenth-century encyclopedic work linked double-entry bookkeeping and business arithmetic with Pythagorean harmonies and the music of the spheres… Pacioli’s Summa represents something of a landmark. Within the covers of this one book can be found all the varied between schoolmen and mysteries of double-entry bookeeping for mechants, so too he underlined the importance of the study of Euclid for Surveyors, architects and other ‘universal men.’ [ix]

In “The Beauty of Double-Entry Bookkeeping and its Impact on the Nature of Accounting Information,” (written in celebration of Summa’s 500th anniversary), Yuri Ihri writes, “the essence of double-entry bookkeeping is not just a contrast between balance sheet accounts and income statement accounts, but, more generically, a contrast between state accounts and explanatory accounts, with the latter explaining changes in the former.” Note that these are two different things. Ihri continues,

This essence, which is stated here in the form of axioms of double-entry bookkeeping are done not globally but myopically and incrementally, which is of double-entry bookkeeping on the nature of accounting information is analyzed accounts. Turning somewhat philosophical, “difficulty, efficiency and originality” are regarded as being the three ingredients of intellectual beauty. Double-entry bookkeeping is found to have all three and to be a “thing of beauty” indeed, as stated by Goethe, Cayley and Sombart, whose quotes are given at the beginning of the paper.[x]

Those quotes are,

“What a thing it is to see the order which prevails throughout his business! By means of this he can at any time needing to perplex himself in the details.What advantages does he derive from the system of bookkeeping by double-entry! It is among the finest inventions of the human mind.” (Goethe, 1824., Vol. I, Book 1, Chapter X. p. 28, translated by Thomas Carlyle). “The Principles of Book-keeping by theory which is mathematically by no means uninteresting: it is in fact like Euclid’s theory of ratios an absolutely perfect one, and it is only its extreme simplicity which prevents it from being as interesting as it would otherwise be. (Cayley, 1907).

“Double-entry bookkeeping is bourne of the same spirit as the system of Galileo and Newton… With the same means as these, it orders the phenomenon into an elegant system, and it may be called built on the basis of mechanistic thought. Double-entry bookkeeping discloses to us the cosmos of the economic world by the same method as, later, the cosmos of the stellar universe was unveiled by the great investigation of natural philosophy… One can scarcely conceive of capitalism without double-entry book-keeping: they are related as are form and context. It is difficult to decide, however, whether in double-entry book-keeping capitalism provided itself with a tool to make it more effective, or whether capitalism derives from the ‘spirit’ of double-entry book-keeping”. (Sombart, 1928. Vol. II, Part I, p. 118-9).[xi]

In spite (or perhaps because) of these cosmic qualities, nothing in Summa reads strange to a businessperson today. Pacioli describes journals, ledgers, inventories, accounts receivable and payable, trial balances, income, expenses, trades and exchanges, salaries, duplicate receipts, “sales for cash or on time with brokers’ commissions,” profit, loss and other concepts and practices that have hardly changed in most of a millennium. His instructive tone is also familiar:

He who wants to know how to keep a ledger and its journal in due order must pay strict attention to what I shall say. To understand the procedure well, we will take the case of one who is just starting in business, and tell how he must proceed in keeping his accounts and he may find each thing in its place. For, if he does not put each thing in its own place, he will find himself in great trouble and confusion as to all his affairs, according to the familiar saying, Ubi non est ordo, ibi est confusio (Where there is no order, there is confusion).

Central to bookkeeping — then and now — are its three books: the memorandum, the journal and the ledger. Here is a compression of Pacioli’s teachings, taken from a series of chapters in Summa:

The memorandum book… is a book in which the merchant shall put down all his transactions, small or big, as they take place, day by day, hour by hour. In this book he will put down in detail everything that he sells or buys, and every other transaction without leaving out a jot; who, what, when, where, mentioning everything to make it fully as clear as I have already said in talking about the Inventory, so that there is no necessity of saying it over again in detail.

…The bookkeeper will put everything in order before he transcribes a transaction in the journal. In this way, when the owner comes back he will see all the transactions, and he may put them in a better order if he thinks necessary. Therefore, this book is very necessary to those who have a big business.

…After you have proceeded on this way through all the accounts of the Ledger and Journal and found that the two books correspond in debit and credit. It will mean that all the accounts are correct and the entries entered correctly.

…After you have finished checking off the Journal, if you find in the Ledger some account or entry which has not been checked off In debit or credit, this would indicate that there has been some mistake in the Ledger… and you shall correct this error.

Throughout Summa, Pacioli invokes the context of balance. Balancing books also balances a functioning business in the world. It is an exercise as normal and necessary as walking upright on two feet.

MOMENTS IN DOUBLE-TIME

In 1913 Charles M. Van Cleve self-published Principles of Double-Entry Bookkeeping. His purposes were to “to explain the principles which underlie the art of accounting by the double-entry method,” and to solve “the problem of placing double-entry bookkeeping on a rational basis”:

As a rule, the study of a useful art has a certain value as mental discipline; the art of accounting is the one exception to the rule. Aside from the so-called occult sciences, there is nothing which so tends to bewilder the mind and to dull the faculty of reason as the study of double-entry bookkeeping in the form in which it is customary to present it.[xii]

In our time, double-entry bookkeeping has fallen out of favor after a six century run. Today accounting is done on computers, with software packages, the most popular of which is Quickbooks, which boasted a 94.2% share of retail units in the business accounting category in 2008. [xiii]  Quickbooks is built for single-entry bookkeeping. Yes, you can get it to do the double-entry kind, though not in ways that make sense to double-entry stalwarts. One of those is Jim Reverend, who blogged this in 2006:

A few years ago, just for fun, I taught myself Double Entry Accounting. I found the whole process very interesting and was intrigued by the fact that so many people would go through so much trouble to learn what amounts to nothing more than a hunk of theory and procedures developed over 500 years ago that have changed very little since then. I really enjoyed the simplicity of the system and the obvious nature of its rules.

I assumed that keeping track of my business’ finances using accounting software would be a relatively straight-forward task, so I set out in search of this software. Quickbooks came highly recommended by almost everyone I asked so I purchased the “Pro” version. $150 later and 10 minutes into using the software and I found myself angry, confused, and sitting in a pile of my own hair.

While Quickbooks may indeed perform Double Entry Accounting in the background, using it is nothing like the simple system of checks and balances that I learned. Quickbooks breaks everything down into common business aspects and concepts and takes the accounting out of it as much as possible. This is great if you don’t know accounting and your business doesn’t deviate too far from the norm. However, if you intend to make even the slightest curve away from a “normal” usage pattern, you’ll find that the software gets in your way more than anything. So I’ve found that my knowledge of Double Entry Accounting isn’t nearly as useful as I thought it would be and, instead, I’m now giving myself a profanity-studded crash-course in manipulating “Quickbooks” into doing what I want.[xiv]

When we go back to Van Cleve, we begin to see why Reverend got so frustrated with Quickbooks’ new double-entry conventions:

The whole difference, and the only difference, between the two systems of accounting is in the fact that single-entry bookkeeping always uses literal language, while double-entry bookkeeping always uses figurative language except when speaking of persons. As soon as one understands the figurative language which it uses, double-entry bookkeeping is just as simple as single-entry bookkeeping — and much more compact.

In single-entry bookkeeping, cash means cash. Merchandise means merchandise. Interest means interest. Expense means expense. But in double-entry bookkeeping cash does not mean cash; it means the imaginary person who owes the amount of the cash. Merchandise does not mean merchandise; it means the imaginary person who owes the amount of the merchandise. Interest does not mean interest; it means the imaginary person who owes or is owed the amount of the interest. Expense does not mean expense; it means the imaginary person who owes the amount of the expenses. Net Capital does not mean net capital; it means the person (real in the case of an individual owner, imaginary in the case of a firm or a corporation) who is owed or owes the amount of the net capital.

This kind of abstraction may seem to detach meanings, but instead they are useful generalizations. Quickbooks insists on a specificity that loses the virtues of abstraction. Here’s Reverend again:

If you want to “pay a bill” (an annoying feature of Quickbooks that you are all but required to use) you will be annoyed every time you do unless you have a “Credit Card” defined. I don’t have a business credit card. I don’t really need one. Despite this, I ended up making a fake “Credit Card” account just to get it to shut up.

You can only pay bills by “Check” or “Credit Card”. You cannot use “Cash”, “Accounts Payable” or “Owner’s Equity” to do so. Oftentimes, I “pay bills” with my personal funds which are not tracked along with my business accounts. So, in order to work around this, I had to create a “Credit Card” account for myself at the “Bank of Daniel”. Any expenses that are paid with personal funds are treated as charges on the “Bank of Daniel” “Credit Card”. Every now and then (once a month, probably) I’ll submit a transaction to pay off the debt on this “Credit Card” with funds from “Owner’s Equity”.

Van Cleve’s case was for all-rational double-entry bookkeeping: “What this treatise has accomplished is to prove that double-entry bookkeeping is a rational process and therefore does not involve the necessity of using irrational language.” [xv] His final paragraph is a Victorian huff:

When accountants learn to use words in their proper sense, when they learn to say asset when they mean asset, liability when they mean liability, and net capital when they mean net capital, they will be surprised to find how much higher a place their occupation will hold in public esteem.

Van Cleve won. Pacioli lost. In place of double-entry bookkeeping’s well-abstracted “irrational” language is an all-literal vernacular, formalized in Quickbooks. Gone also is what Van Cleve failed to appreciate, even if he understood it: that bookkeeping isn’t just about keeping books, or recording profits and losses. It’s about the business’s own narrative. That narrative maintains the integrity of the business itself and its connection to the world. It’s also a way to maintain the form of coherence we call sanity. We have, as they say, lost it.

This was an observation made by Dan Palanza more than three decades ago.

MAKING THE CONNECTIONS

I first met Dan Palanza in September 2010, when I was in Woods Hole with friends. One of those was Andy Maffei, a scientist with the Woods Hole Oceanographic Institution. Andy had pulled together a small group to hear Dan share what he had learned about bookkeeping, a subject Dan had studied intensively over the last three decades. In recruiting me, Andy wrote, “Dan has convinced me that Book-keeping is actually a language that is used to describe energy transfers between two entities where there are two paired components, one physical and one intellectual. It is a way both to describe that transfer and to analyze and represent the balance inherent in such transfers.”

While Dan’s topic is book-keeping [2], his subtopics include thoughts and works by Einstein, Lewis HydeDenise Schmandt-Besserat’s history of counting and writing, four kinds of arithmetic, computing, software, linguistics, the construction business, and the financial meltdown. The list is actually much longer, but that gives you a sense of Dan’s scope. Dan’s story begins in the 1950s, when he worked at General Electric:

In those days the company had a well-refined double-entry book-keeping framework. It ran a complex manufacturing operation building steam turbines, generators and ship propulsion systems. These manufacturing operations were run by a book-keeping journal that used mimeograph business cards as control. The control cards carried production operations as shop work-orders and were returned with accounting data telling which pieceworkers completed each operation.  When the journal data was used to generate ledger reports, those reports were detailed to treat each shop foreman as an individual business within the business. The technical term for this level of book-keeping is “cost accounting.” Note that cost accounting and production operations were connected in this system, which was still the one Pacioli described. What GE also had was a network business architecture. The pieces were all functionally connected, and these connections transcended corporate hierarchy.

For many years after leaving GE, Dan didn’t give book-keeping much thought, beyond remembering with admiration how it worked. By the 1970s he had returned to his family’s construction business, and by 1979 was specializing in energy-efficient homes. The first personal computers were in the world then, so Dan decided to get an Apple II and a book-keeping program, in faith that he would find in the program the same deep cost accounting methods he had learned at GE twenty years earlier. “I assumed that book-keeping was book-keeping,” he said, “even if it was done on a PC. But it didn’t work out that way.” What Dan found was that accounting systems on early PCs were flawed:

Essential pieces were missing. There no cost-accounting, no network architecture. I saw problems not only for my own business, but for the whole financial system that would be built on top of inadequate programs like the ones I saw at the time, and on through the 1980s. Even though these were business applications, they were built to serve isolated needs: filling out checkbooks, paying taxes, putting stuff in lightweight databases and spreadsheets. None of them implemented the journal | ledger pattern, which is fundamental to a proper book-keeping framework. They skipped the journal entirely, posting transactions directly into a relational database, which was fine for doing what databases do, but what databases don’t includes double-entry book-keeping.

In 1985, when Dan’s daughter Laureen opened a small business in Falmouth, Dan decided to learn programming, and developed his own full cost-accounting system with a network business architecture. Laureen’s place became Dan’s own little General Electric. Then, after Laureen’s was sold in 1995, Dan set about re-constructing book-keeping’s universal framework of rules. Like Pacioli, Dan mission was to understand and codify the fundamentals of an applied science. Unlike Pacioli, Dan was operating in a world where the science was no longer applied. So Dan got a Small Business Innovative Research (SBIR) grant from the National Science Foundation in 1998, and competed his project in 2003. He did this alone, since there was no peer group for his work, and no standing interest in what otherwise looked like an utterly mundane subject. Since then Dan has been studying Einstein, Gödel, von Neumann, Heisenberg and other Deep Dudes, making connections between their work—both finished and unfinished—and book keeping, plus three other subjects that explain why this chapter is here: the market, the Internet and the commons.

If we want the Internet’s commons to function fully as a marketplace, Dan says, we’re going to need double-entry bookkeeping. Put more simply, business will need to become sane again. We don’t need Dan to tell us business is insane now. But it might help to report that Dan saw the loss of double-entry book-keeping writ large in the dot-com and housing industry meltdowns, both of which he predicted years before they happened.

He doesn’t blame business leaders or governments for not getting it. He blames a lack of tools. Business without double-entry book-keeping is like mathematics without calculus. You still can do a lot, but you’re crippled if you want to look at—say, change. Not that Dan is a pessimist. He sees the lack of book-keeping tools as an opportunity. “If we bring back double-entry book-keeping—to business, to the commons, to the Internet, to the marketplace, and to our everyday lives—we’ll start another renaissance.”

DEMAND AND SUPPLY

The expression “supply and demand” was first coined as “demand and supply” by James Denham-Steuart in An Inquiry into the Principles of Political Oeconomy, written in 1767. [xvi] In his Inquiry, Denham-Steuart says of demand, “it must constantly appear reciprocal. If I demand a pair of shoes, the shoemaker either demands money, or something else for his own use.” He goes on to describe seven qualities of demand, the sixth of which is, “The nature of demand is to encourage industry.”

In The Wealth of Nations, published nine years later, Adam Smith wrote, “The real and effectual discipline which is exercised over a workman is that of his customers. It is the fear of losing their employment which restrains his frauds and corrects his negligence.” What these two bright bulbs of the Scottish Enlightenment both illuminated—the necessity for strong connections between customers and companies—fell into darkness in the Age of Industry. As the mass market replaced the literal one, the importance of individual customers to large businesses diminished. Actual conversation between company and customer was a cost to be minimized, rather than a source of intelligence and discipline.

SO, THEN

In recent years we have seen many ways in which bridges between customers and companies can be built, some of which we reviewed back in the Asymmetrical Relations chapter. But none of these are more than partial systems. And none of them take full advantage of the Net’s nature as a commons, and as a marketplace. Which means there are many opportunities ahead of us—especially if we take a few lessons from our Italian and Scottish teachers.

As of today, ProjectVRM is eight years old.

So now seems like a good time for a comprehensive (or at least long) report on what we’ve been doing all this time, how we’ve been doing it, and what we’ve been learning along the way.

ProjectVRM has always been both a group effort and provisional in its outlook and methods. So look at everything below as a draft requiring improvement, and send me edits, either by email (dsearls at cyber dot law dot harvard dot edu) or by commenting below.

Summary

After eight years of encouraging development of tools and services that make individuals both independent and better able to engage, ProjectVRM (VRM stands for vendor relationship management) is experiencing success in many places; most coherently in France, the UK and Oceania (Australia and New Zealand). There are now dozens of VRM developers (though many descriptors besides VRM are used), and investor interest is shifting from the “push” to the “pull” side of the marketplace. Government encouragement of VRM is strongest in the UK and Australia.  ProjectVRM and its community are focused currently on “first person” technologies, privacy, trust, identity (including anonymity), relationship (including experience co-creation), substituability of services and the Internet of Things. Verticals are personal information management, relationship (VRM+CRM), identity, on-demand services, payments, messaging (e.g. secure email), health, automotive and real estate.  There are many possibilities for research, possibly starting with the effects on business of individuals being in full control of their sides of agreements with companies.

1. History

ProjectVRM is one of many research projects at the Berkman Center for Internet and Society at Harvard University. It started when I began a four-year fellowship at Berkman in September, 2006. In those days Berkman fellows were encouraged to work on a project. I had lots of guidance from Berkman staff and other veterans; but what best focused my purpose was something Terry Fisher said at one of the orientation talks. He said Berkman did its best to be neutral about the subjects it studies, but also that “we do look for effects.”

The effect-generating work for which I was best known at the time was The Cluetrain Manifesto, which I co-authored seven years earlier with Chris Locke, David Weinberger and Rick Levine. By most measures Cluetrain was a huge success. The original website launched a meme that won’t quit, and the book that followed was a bestseller.(It still sells well today). But I felt that its alpha clue, written by Chris Locke, still wasn’t true. It said,

we are not seats or eyeballs or end users or consumers.
we are human beings and our reach exceeds your grasp. deal with it.

There is a theory in there that says the Internet gives human beings (the first person we) the reach they need to exceed the grasp of marketers (the second person your).

So either the theory wasn’t true, or the Internet was a necessary but insufficient condition for the theory to prove out. I went with the latter and decided to to work on the missing stuff.

That stuff couldn’t come from marketers, because they were on the second person side. In legal terms, they were the second party, not the first. This is why their embrace  of  Cluetrain’s “markets are conversations” couldn’t do the job. Demand needed help that Supply couldn’t provide. What we needed, as individuals, were first party solutions — ones that worked for us.

The more I thought about the absence of first party solutions, the more I realized that this was a huge hole in the marketplace: one that was hard to see from the client-server perspective, always drawn like this:

While handy and normative, client-server is also retro. Here’s a graphic from Virtual Teams: People Working Across Boundaries with Technology (Jessical Lipnack and Jeffrey Stamps, 2000,  p. 47) that puts it in perspective:

Client-server is hierarchical, bureaucratic industrial and agricultural (see the image below). But it’s also most of what we experience on the Web, and also where the entirety of the supply side sits. So, even if Cluetrain is right when it says (in Thesis #7) “hyperlinks subvert hierarchy,” subversion goes slow when the people running the servers are in near-absolute control and hardly care at all about links. In less abstract terms, what we have on the Web is this:

As clients we go to servers for the milk of text, graphics, sound and videos. We get all those, plus cookies (and other tracking methods) to remember who we are and where we were the last time we showed up. And, since we’re just clients, and servers do all the heavy lifting  (and with technology what can be done will be done) the commercial Web’s ranch has turned into what Bruce Schneier calls Our Internet surveillance state.

By 2006 it was already clear to me that we could make the whole marketplace a lot bigger if individuals were fully capable human beings and not just calves — if we equipped Demand to drive Supply at least as well as Supply drives Demand.

To help people imagine what will happen when Demand reaches full power, I wrote a Linux Journal column a few months earlier, titled “The Intention Economy.” Here’s the gist of it:

The Intention Economy grows around buyers, not sellers. It leverages the simple fact that buyers are the first source of money, and that they come ready-made. You don’t need advertising to make them.

The Intention Economy is about markets, not marketing. You don’t need marketing to make Intention Markets.

The Intention Economy is built around truly open markets, not a collection of silos. In The Intention Economy, customers don’t have to fly from silo to silo, like a bees from flower to flower, collecting deal info (and unavoidable hype) like so much pollen. In The Intention Economy, the buyer notifies the market of the intent to buy, and sellers compete for the buyer’s purchase. Simple as that.

The Intention Economy is built around more than transactions. Conversations matter. So do relationships. So do reputation, authority and respect. Those virtues, however, are earned by sellers (as well as buyers) and not just “branded” by sellers on the minds of buyers like the symbols of ranchers burned on the hides of cattle.

The Intention Economy is about buyers finding sellers, not sellers finding (or “capturing”) buyers.

In The Intention Economy, a car rental customer should be able to say to the car rental market, “I’ll be skiing in Park City from March 20-25. I want to rent a 4-wheel drive SUV. I belong to Avis Wizard, Budget FastBreak and Hertz 1 Club. I don’t want to pay up front for gas or get any insurance. What can any of you companies do for me?” — and have the sellers compete for the buyer’s business.

This car rental use case is one I’ve used to illustrate what would be made possible by “user-centric” or “independent” identity, which was also the subject of the cover story in last October’s Linux Journal, plus this piece a year earlier, and various keynotes I’ve given at Digital Identity World, going back to 2002. It is also the use case against which the new open source Higgins project was framed.

Even though I’ve been thinking out loud about Independent Identity for years, I didn’t have a one-word adjective for the kind of market economy it would yield, or where it would thrive. Now, thanks to all the unclear talk at eTech about attention, intentional is that adjective, because intent is the noun that matters most in any economy that gives full respect to what only customers can do, which is buy.

Like so many other things that I write about (including everything I’ve written about identity), The Intention Economy is a provisional idea. It’s an observation that might have no traction at all. Or, it might be a snowball: an core idea with enough heft to roll, and with enough adhesion to grow, so others add their own thoughts and ideas to it.

So that’s the purpose I chose for my new Berkman project: to get a snowball of development rolling toward the Intention Economy.

The project has been lightweight from the start, consisting of myself* and other volunteers. Our instruments are this blog, a wiki, a mailing list and events. In gatherings of project volunteers at Berkman and elsewhere, we narrowed our focus to encouraging development of tools for independence and engagement. That is, tools that would make individuals both independent of other entities (especially companies) and better able to engage with them. These shaped the principles, goals and tools listed on our wiki.

The term VRM came about accidentally. I was talking about my still-nameless project on a Gillmor Gang podcast in October 2006. Another guest on the show, Mike Vizard, started using the term VRM, for Vendor Relationship Management — or the customer-side counterpart of CRM, for Customer Relationship Management, which was then about a $6.2 billion B2B software and services industry.  (It’s now past $20 billion.) The Gillmor Gang is a popular show, and the term stuck. It wasn’t perfect (we wanted a broader focus than “vendors,” which is also a B2B term, rather than C2B). But the market made a decision and we ran with it. Since then VRM has gained a broader meaning anyway. Every thing (hardware, software, policies, legal moves) that enables an individual to interact with full agency in any relationship is a  VRM thing. “RM” turns out to  be handy for sub-categories as well, such as GRM (government relationship management) and HRM (health relationship management).

ProjectVRM has always been unusual for Berkman in two ways. One is that it has been focused on business — the commercial side of the “society” in Berkman’s name. The other is that it put the development horse ahead of the research cart. So, while we always wanted to do research (and did some along the way, such as with ListenLog), we felt it was important to create research-worthy effects first.

My first mistake was thinking we would have those effects within a year. My second mistake was thinking we would have them within four years — the length of my fellowship. It has taken twice that long, and still requires one more piece. More about that below, in the Research and Opportunities sections.

In its early years, when it was pure pioneering, ProjectVRM had a lot of volunteer organizational help. There were weekly conference calls and meetings, and events held in Cambridge, London, San Francisco and elsewhere. But the main gatherings from the start were at the Internet Identity Workshop (IIW), an unconference I co-organize at the Computer History Museum in Mountain View. (Our next VRM Day is 27 October. Register here.)

IIW also started with Berkman help. It was first convened as a group I pulled together for a December 31, 2004 Gillmor Gang podcast on identity. Steve Gillmor called the nine participants in the show “The Identity Gang.” The conversation continued by phone and email, with growing energy. So we convened again, this time in person with a larger group, in February 2005 at Esther Dyson’s PC Forum in Scottsdale, Arizona. It was there that John Clippinger asked if we would like “a clubhouse” at Berkman. I said yes, and John had Paul Trevithick create a Berkman site for the gang. As interest collected around the site and its list, three members — Phil Windley (then CIO of Utah), Kaliya Hamlin (aka “IdentityWoman“) and I morphed the gang meetings into IIW, which met for the first time in Fall of 2005. Our 19th is coming up on 28-30 October. (Register here.)  It tends to have 180-250 participants from all over the world. While identity remains the central theme, as an unconference its topics can be whatever participants choose. VRM is always a main focus, however. And we always have a “VRM Day” at the Museum the day before IIW. The next is on 27 October. It’s free.

The Identity Gang  also grew out of other efforts by a number of individuals and groups:

I’ll leave it at those for now. Others can add to it and help me connect the dots later. What matters is that ProjectVRM has both roots and branches that intertwine with the digital identity movement. I unpack more in the Community section below. Meanwhile it is essential to note that Kim Cameron’s Seven Laws of Identity had a large guiding influence on ProjectVRM. This is partly because they were all good laws, but mostly because they came from the individual’s side:

  1. User control and consent
  2. Minimal disclosure for a constrained use
  3. Justifiable parties (“disclosure of identifying information is limited to parties having a necessary and justifiable place in a given identity relationship”)
  4. Directed identity (“facilitating discovery while preventing unnecessary release of correlation handles”)
  5. Pluralism of operators and technologies
  6. Human integration
  7. Consistent experience across contexts

As you see, all of those should apply just as well to VRM tools and services.

We have had two interns in our history, both hugely helpful. The first was Doug Kochelek, an HLS law student with a BS and a EE from Rice. He came on board at the very beginning, in September 2006. He’s the guy who worked with Berkman’s Geek Cave to create the wiki, the blog and the list. He also shook down many technical problems along the way. The second was Alan Gregory, a 2009 summer intern and a law student at the University of Florida. Alan helped with research on the chilling effects of copyright expansion on Web streaming, which was a focus of a research project we did with PRX called ListenLog — a self-tracking feature installed in PRX’s Public Media Player iPhone app. (Here’s a presentation Alan and I did at a Fellows Hour.) ListenLog was the brainchild of Keith Hopper, then of NPR, and was years ahead of its time. Work on those projects was funded by a grant from the Surdna Foundation.

To keep its weight light and its work focused on development and relevant issues, ProjectVRM does not have its own presence on Twitter or Facebook. Its social media activity is instead comprised of postings by individual participants in the project, and the memes they drive. #VRM, for example, gets tweeted plenty, and has come to serve as shorthand for individual empowerment.

In 2007 we did a good job of publicizing what VRM and ProjectVRM were about, and got a lot of buzz. It was  premature, and our first big lesson: it’s not good to publicize anything for which the code isn’t ready. In the absence of code, it’s easy for commentators (such as here) to assume that what we’re trying to do can’t be done.

So we got more heads-down after that, and avoided publicity for its own sake.

not_iball1Still, the idea of VRM is attractive, especially to folks at the leading edge of CRM. This is what caused nearly an entire issue of CRM magazine to be devoted to VRM ,in May 2010. It too was ahead of its time, but it helped. So did two books that came out the same year: John Hagel’s The Power of Pull, and David Siegel’s Pull: The Power of the Semantic Web to Transform Your Business. John also helped in June 2012 with The Rise of Vendor Relationship Management.

That essay was a review of  The Intention Economy: When Customers Take Charge, which arrived in May from Harvard Business Review Press. The book reported on VRM development progress and detailed the projected shifts in market power that I first called for in my 2006 column with the same title.

While  The Cluetrain Manifesto has been a bigger seller, The Intention Economy Intention-economy-cover has had plenty of effects. Currently, for example, it is informing the work of Mozilla’s commercial arm, headed by Darren Herman, who this year hired @SeanBohan from the VRM talent pool. (Here’s a talk I gave at Mozilla in New York last month.) On the publicity side, the book was compressed to a Wall Street Journal full-page Review section cover essay titled “The Customer as a God.”

So far ProjectVRM has one spin-off: Customer Commons, a California-based nonprofit. Its mission is “restore the balance of power, respect and trust between individuals and organizations that serve them.” CuCo is a membership organization with the immodest ambition of attracting “the 100%.” In other words, all customers. And it is modeled to some degree on Creative Commons CustomerCommonsLogo4(a successful early Berkman spin-off), by serving as the neutral place where machine- and person-readable versions of personal terms, conditions, policies and preferences of the individual can be maintained. Among those terms will be those restricting or preventing unwanted tracking, and among those policies will be those establishing the boundaries we call privacy. Customer Commons is a client of the Cyberlaw Clinic, which is helping develop both. But much more can be done. We’ll visit that in the Opportunities section below.

2. Development

The list of VRM developers is now up to many dozens. While most don’t use the term “VRM” in marketing their offerings (nor do we push it), the term is gathering steam. For example, while updating the developers list a few minutes ago, I found two new companies that use VRM in the description of their offerings: InformationAnswers (“Where CRM meets VRM.”) and PeerCraft (“The main purpose for PeerCraft is to support Vendor Relation Management.”)

Some developers on our list are now familiar brands, though none started that way, and most did not exist when ProjectVRM began. Some of the successes (e.g. Uber and Lyft) have not been directly engaged with ProjectVRM, but are listed because they are what we call “VRooMy.” Other successes (e.g. Personal.com, Reputation.com and GetSatisfaction) have been engaged, one way or another. One that got a lot of notice lately is Thumbtack, for picking up a $100 million investment from Google. That’s atop the $30 million they got earlier this year.

In fact many VRM developers are now having an easier time getting money, thanks to a trend on which ProjectVRM has had influence: a shift of market interest away from “push” (e.g. advertising) and toward “pull” (e.g. VRM). (More about investment below.)

Several years ago, a bunch of VRM developers (and I) worked on developing SWIFT’s Digital Asset Grid. (SWIFT is the main international system for moving money around, and is headquartered in Belgium.) The code is open source, as is other VRooMy work in the financial sector. (Such as the stuff being done by the Romanian company I wrote about here.) OIX also maintains a set of “trust frameworks,” one of which is at the heart of the Respect Network, which I’ll unpack below.

While there is a lot of development in the U.S., and there are VRM startups scattered around the world, the three main hotbeds of activity are the UK, France and Oceania (Australia and New Zealand). Each is a community of its own, cohering in different ways. It’s helpful to visit each, because they represent unique contexts and resources for moving forward.

The UK

In the UK, government is central, through a role one official there calls “being a giant consumer of personal data from citizens.” It gets that data either from individuals directly or from companies that provide individuals with what are called variously called personal clouds, data stores, lockers and vaults. While all these companies perform as intermediaries, they work primarily for the individual. To differentiate this new class of company from traditional third parties, ProjectVRM calls them “fourth parties”. (That term is alien to lawyers, but is catching on anyway. For example, there is a new VRM company in Australia with the name “4th Party.”)

Leading the UK government in a VRooMy direction from the inside is in the Efficiency and Reform Group of the Government Digital Service (GDS) in the Cabinet Office.  In this presentation by Chris Ferguson, Deputy Director of the GDS we see the government pulling in big companies (e.g. Google, Equifax, Lexis-Nexis, Experian, Paypal, Royal Mail, BT, Amazon, O2, Symantec) to legitimize and engage fourth parties serving individuals (e.g. Mydex, Paoga and Allfiled).

Two outside groups working with the UK government are Ctrl-Shift and OIX (Open Identity Exchange). Ctrl-Shift is a research consultancy that has been engaged with ProjectVRM from the beginning. OIX is a Washington-based international .org focused on ‘building trust in online transactions.’

France

VRM is a familiar and well-understood concept in France. There are meetups (such as this one) and many VRooMy startups, such as Privowny (led by French folk and HQ’d in Palo Alto), CozyCloud, and OneCub. A big organizational driver of VRM in France is Fing.org, a think tank that brings together large companies (e.g. Carrefour, Societe General, Orange and LaPoste) with small companies such as the ones I just mentioned. They do this around research projects. For example, ProjectVRM informed Fing’s Mesinfos research project (described here).

Oceania

If we were to produce a heat map of VRM activity, perhaps the brightest area would be Australia and New Zealand. I’ve been down that way three times since June of last year, to help developers and participate in meetings and events. As with the UK, government in Australia is very supportive of VRM development, and with empowering individuals generally. (We met with three agencies on one of the trips: one with the federal government in Canberra and two with the New South Wales government in Sydney. One of them called citizens “customers” of government services, because “they pay for them.”) Startups there include Flamingo, Meeco, Welcomer, Geddup,4th Party, Fifth Quadrant, Onexus and the New Zealand based MyWave.

Recent changes in Australian privacy policy also attract and support VRM development. Australian companies (and government agencies) collecting personal data from people on the Web (or anywhere) are now required to make that data available to those people to use as they please. (Or so I understand it.) This gives Canberra-based Welcomer, for example, a reason to exist. Welcomer makes “private data dashboards” that “show collected summaries of the personal data held by organisations and by individuals including the person themselves. The dashboard gives a summary of personal data with the ability to link through to the source data (where required).”

This summer, the first commercial community to grow out of ProjectVRM work, the Respect Network (which Privacy By Design (PbD) calls the “World’s First Global Private Cloud Network”) held a world tour to launch the community and stimulate funding for members’ common goals, standards and code development. I was on the tour (London, San Francisco, Sydney, Tel Aviv), and wrote a report on the ProjectVRM blog. (Naturally, I shot pictures. Those are here. I also spoke at each venue. 3. Community

To understand where ProjectVRM fits in the world, and how it works, I like the Competing Values Framework by Kim S. Cameron (no relation to the one above), Robert E. Quinn, Jeff DeGraff and Anjan Thakor:

While there are many VRM developers operating in the lower half of that graphic, what ProjectVRM does is in the upper half of that diagram.  We have a collaborative clan of flexible and creative individuals in an adhocracy, working together on long-term transformational change.

Pretty much everything that gets criticized about our efforts falls in the lower half. That’s because we have no hierarchy and don’t work to control what anybody does. And progress on the whole  has been slow. (Though there are exceptions, such as Uber, Lyft and Thumbtack.)

That graphic is just one of many helpful ones in David Ronfeldt‘s Organizational forms compared, which he’s been updating since first publishing it in May 2009. One reason it is helpful is that the hierarchical short-term stuff is obvious and easily understood, while collaborative long term stuff is much harder to grok. It’s like the difference between weather and geology. Which makes me think that graphic should be flipped vertically: slow stuff on the bottom, fast stuff at the top. That’s what the Long Now foundation does with this graphic, which I’ve always loved:

The change we want most is down in the culture, governance and infrastructure layers, even though our focus is on commerce. This also explains why we run into trouble when we play with fashion. The last thing we want is for VRM to be cool. (This is also a lesson I learned and re-learned over two decades of watching Linux, free software and open source for Linux Journal.)

In Spinuzzi’s Losing by Expanding: Corralling the Runaway Object, an object is identified as “a material or problem that is cyclically transformed by collective activity.” With our tacit, inductive and flexible approach, this also characterizes the way our community works.

One can see all this at work on the ProjectVRM mailing list, an active collection of 615 subscribers. We also meet in person twice a year at IIW, starting one day in advance of the event, with “VRM Day.” This adds up to a total of at least eight days per year of in-person collaboration time.

Most of the rest of the VRM community meets locally, or through the organizing work of organizations such as Respect Network (U.S. based, but spanning the world) and Fifth Quadrant (Sydney based, and focused on Australia and New Zealand).

If things go the way I expect, Mozilla will also emerge as a center of VRM interest and development as well. (For example, I expect VRM to be a topic in October at MozFestival in the U.K.

4. Influence

Nearly all VRM influence derives from the work of its volunteers and its developers. “Markets are conversations,” Cluetrain said, and we drive a lot of those. But they rarely get driven exactly the way I, or we, would like. Conversations are like that. EIC awardSo are heterarchical networks. Everybody wants to come at issues from their own angle, and often with their own vocabulary. We see that especially with analysts and think tanks. None of them like the term VRM. (In fact lots of developers avoid it as well. I don’t blame them, but we’re stuck with it.) Ctrl-Shift, for example, calls fourth parties PIMS, for Personal Information Management Services. Kuppinger-Cole, which gave ProjectVRM an award in 2008 (that’s the trophy on the right), insists on the term “Life Management Platforms.” (I pushed it for awhile. Didn’t take.) Here in the U.S., Forrester Research calls the same category PIDM for Personal Identity and Data Management. We don’t care, because we look for effects.

As for the influence of others on ProjectVRM, there are too many to list.

5. Issues

Privacy is the biggest one right now. (A Google search brings up more than five billion results). We’ve done a lot to drive interest in the topic, and have brought thought leadership to the topic as well. (Here is one example.) On behalf of ProjectVRM, I’ve participated in many privacy-focused events, such as the Data Privacy Hackathon earlier this year, and at GovLab gatherings such as the one reported on here. I’m also in Helen Nissenbaum‘s Privacy Research Group at the NYU Law School, where I presented ProjectVRM developers’ privacy work on February 26 of this year.

Tied in with privacy online, or lack of it, is users’ need to submit to onerous terms of service and meaningless privacy policies. Those terms, also called contracts of adhesion, have been normative ever since industry won the industrial revolution, but have become especially egregious in the online world. Today there is a crying need both for better terms on the sites’ and services’ side, and for terms individuals can asset on their side. From the beginning ProjectVRM has been focused mostly on the latter.

Trust is another huge issue, also tied with privacy. ProjectVRM has both encouraged and influenced the growth of “trust frameworks” such as the Respect Trust Framework and others (there are five) at OIX, as well as Open Mustard Seed and OpenPDS under IDcubed at the MIT Media Lab.

VRM+CRM has been a focus from the start, but the timing has not been right until now. At the beginning, we expected CRM companies to welcome VRM. Press and analysts in the CRM space were encouraging from the start (CRM Magazine devoted an entire issue to it in 2010), but the big CRM companies showed little interest, until this year.

Sitting astride or beside VRM and CRM is a category variously called CX (for Customer Experience), CRX (for Customer Relationship Experience), EM (for Experience Management) CEM or CXM (for Customer Experience Management) and other two and three-letter initialisms. Another happening in the midst of all these is “co-creation” of customer experience. The purpose here is to bring customers and companies together to co-create experience in a lab-like setting where research can be done. This is what Flamingo does in Australia. In a similar way, MyWave in New Zealand (with developers in Australia) “puts the customer in charge of their data and the experience” for a “direct ‘segment of one’ relationship with businesses.”

With the Internet of Things (IoT) heating up as a topic, there is also an increased focus, on the “own cycle,” rather than the “buy cycle” of the customer experience. I explain the difference here, using this graphic from Esteban Kolsky:

In our lives the own cycle is in fact the largest, because we own things — lots of them — all the time and are buying things only some of the time. In fact, most of the time we aren’t buying anything, or even close to looking. This is a festering problem with the advertising-driven commercial Web, which assumes that we are constantly in the market for whatever it is they push at us. In addition to not buying stuff all the time, we are employing more and more ways of turning advertising off (ad blockers are the top browser extensions). For advertising and ad-supported companies, including millions of ad-supported publishers on the Web, this is a mounting crisis. According to an August 2013 PageFair report, “up to 30% of web visitors are blocking ads, and that the number of adblocking users is growing at an astonishing 43% per year.” In The Intention Economy, I called online advertising a “bubble” and I stand by the claim. It’s just a matter of time.

As the stuff we own gets smart, and as more of it finds its way onto the Net service becomes far more important to companies than sales. And VRM developers are laying important groundwork in service. I wrote about this in Linux Journal last year, drawing special attention to the pioneering work led by Phil Windley, who has been a VRM stalwart since before the beginning. In fact it’s Phil’s work that makes clear that things themselves don’t need to be smart to exist on the Internet. All they need is clouds that are smart, which Phil calls picos for persistent computing objects. In this HBR post I explain how the shared clouds of products can be platforms for relationship between company and customers , with learnings flowing in both directions.

Meanwhile, VRooMy companies like trōv are helping individuals do more with what they own — taking their valuables, and making them more valuable.

6. Verticals

Relationship

This was the first for VRM, and it’s still a primary interest. We need tools on the individual’s side for managing many relationships. There still is not a good “relationship dashboard,” though there are a number of efforts in this direction. But as soon as we have code on the VRM side that matches up with code on the CRM side (including, for example, call centers, which are also interested in VRM), we’ll rock.

Payments

Even though ProjectVRM’s mission is centered around relationship and conversation, transaction is a big part of it too — just not the only part, as business often assumes. Our first efforts, starting in 2006, were around making it as easy as possible for individuals to donate money in one standard way to many different public radio stations.

We have been involved in many meetings and discussions around payments and secure data transactions, and some projects as well. We worked with SWIFT on the Digital Asset Grid, and have been in conversations with banks (e.g. Chase) and VISA Europe for a long time as well. With the rise of alternative currencies (e.g. Bitcoin), distributed accounting (e.g. Blockchain), digital wallets and other new means for transacting and accounting, there are many ways for VRM developments to play.

Email

In what is being called “post-Snowden time,” many new secure and encrypted email approaches have evolved. While some are listed on the ProjectVRM developers list, we haven’t been very involved with them — at least not yet. But we are involved with developers working on privacy-protecting tools that can either be embedded in existing email systems or offer alternative communications “tunnels.”

Personal information Management

There are two breeds of development here.

One is fourth party services and code bases for managing and sharing personal data selectively online. There are now many of these. Some support self-hosting as well. (ProjectVRM has always been supportive of free software, open source, and the “first person technology” and “indie” movements.) One organization, the Respect Network, was created to provide a framework for substitutability of services and apps.

The other is code the individual uses to manage his or her own life, and connections out to the world. This is where calendar, email, IM, to-do lists, password managers and other convenience-producing apps for the connected world come together. There is no leader here, though there are many players, including Apple, Microsoft and Google.  So far, this area has only seen centralized and siloed players, with inherent security and data mining disadvantages. But recently, commercial and open source conversations about a decentralized approach to this opportunity have been taking place.

A test case for VRM that applies to both kinds of solutions is this: being able to change my address, my last name or my phone number for many services in one move. This is exactly what the UK government is calling for from citizens’ personal information management systems (what Ctrl-Shift calls PIMS). A citizen should be able to change her address for the Royal Mail, the Passport Office and the National Health Service, all at once. Apple’s HealthKit and HomeKit, which go live with the release of iOS 8on 9 September, also have some VRM developers excited, because it will make this kind of integration at the individual end easy to do in two verticals: Health and Home Automation.

Health

Early on with ProjectVRM, I avoided health as an issue, because I wanted to see real progress in my lifetime — and I felt that the situation in the U.S. was fubar. But other VRM folk did not agree, and have pushed VRM forward very aggressively in the health field. Dr. Adrian Gropper and Dr. Deborah Peel of Patient Privacy Rights have done a remarkable job of carrying the VRM flag up a very steep and slippery hill. Berkman veteran John Wilbanks is another active ProjectVRM volunteer whose work in health is broad, deep, influential and at the leading edge of the pioneering space where personal agency engages the wild and broken world of the U.S. health care system. Brian Behlendorf, the primary developer of the Apache Web server (which hosts the largest share of the world’s Web sites and services) and the CONNECT open source code base for health service collaboration, is also an active participant in ProjectVRM.

A number of VRM developers are working with, or paying close attention to, Apple’s HealthKit. In the words of one of those developers, “It’s very VRooMy.” HealthKit developments go live when Apple rolls out iOS 8 on 9 September.

Automotive

While a number of car makers are eager to spy on drivers, Volkswagen has put a stake in the ground. In March, Volkswagen CEO Martin Winkerhorn gave a keynote at the Cebit show that drew this headline: “Das Auto darf nicht zur Datenkrake warden.” My rusty Deutsch tells me he’s saying the car shouldn’t be a data octopus.

Toward that end, Phil Windley’s Kickstarter-based  Fuse will give drivers and car owners all the data churned out of their cars’ ODB-II port, which was created originally for diagnostics at car dealers and service stations. With an open API around that data, developers can create apps to alert you to schedule maintenance, monitor your teen’s driving and much more.

Real Estate

The only products that cost us more than cars are homes. Here too we have a VRM advocate in Cambridge-based Bill Wendell of Real Estate Café. He has always been way ahead of his time, but it’s clear his time is coming. (Here’s Bill leading a session on VRM in Real Estate at IIW 18 in May.)

7. Investment

There is an upswing of investment in start-ups on the “pull” — the individual’s — side of the marketplace. Many wealthy individuals, some quite new to tech investing, perceive an opportunity in “pull” side tools, so interest is building, especially in angel funding. There are currently at least three initiatives coming together to invest in VRM or intention based start-ups in Silicon Valley and Europe. This is one of the outcomes of the last IIW (in May of this year), where investment emerged as a big theme, with a number of VC’s for the first time participating in IIW sessions. I’m involved in planning a VRM specific fund, which is still in its preliminary stages. If it moves forward (which I believe it will), it should come into shape by next year.

In some cases government is also involved. In the UK, for example, the SEIS (Seed Enterprise Investment Scheme) program offers huge tax incentives to angel investors.

8. Research

There are many questions we can probe with research, but only one I want to work on in the near term: What happens when individuals come to websites with their own agreeable terms?creativecommons-licenses

Such as, “I’m cool with you tracking me on your site, but don’t follow me when I leave.” And, on the site’s side,  “We’re cool with that.” In proper legalese, of course — but expressed on both sides in code and symbols that work like Creative Commons’ licenses (there on the right).

The Cyberlaw Clinic is already involved, though its work with Customer Commons on a broader set of terms than the one I just mentioned, and Berkman’s own  Privacy Tools for Sharing Research Data could assist with and follow the process, both through the term-creation process and as the terms get implemented in code and materialize on the Web.

We would be dealing with cooperative efforts that require this already. One is Respect Network’s Respect Connect “Login with Respect” button.  As I explain here, the terms of OIX’s Respect Trust frame require the setting of, and respect for, the boundaries of individuals. This can be done, even within the calf-cow framework of client-server.

Respect Connect  is based onXDI, which the Respect Trust Framework also specifies. XDI is a protocol that employs “link respect-connect-buttoncontracts.” Drummond Reed, the father of XDI (and CEO of the Respect Network) describes link contracts as “machine-readable XDI descriptions of the permissions an individual is giving to another party for access to and usage of the owner’s personal data.” Very handy. And binding. In code.

Mozilla has also made efforts in this same direction, most recently with  Persona (there on the right). signinWe can help them out with this work, and I am sure other and other browser makers will also want to get on board — which they should, and with Berkman’s convening power probably will.

At the end of the project we will have both standard terms for posting at Customer Commons and reference implementations hosted by Berkman, or shared by Berkman over Github or some other data repository.

And we would bring to the table many dozens of developers already eager to see increased agency and term-proffering power on the individual’s side. I can easily see privacy dashboards, on both the client and the server sides of websites.

(Thinking out loud here…) We could host focused discussions and invite participants (including law folk — especially students, from anywhere) to vet terms the way the IETF vets Internet standards: with RFCs, or Requests for Comments. Some open source code for this already exists with Adblock Plus’s white list for non-surveillance-based advertisers. I would hope they’d be eager to participate as well. We (ProjectVRM, the Berkman Center or Customer Commons) could publish lists of conformant requirements for website and Web service providers, and lists (or databases) of conformant ones.

This work would also separate respectful actors on the supply side of the marketplace from ones that want to stick with the surveillance model.

While there are lots of things we could do, this is the one I know will have the most leverage in the shortest time, and would be great fun as well.

It is also highly cross-disciplinary, with many lines of cooperation and collaboration within the university and out to the rest of the world. Right at Berkman we have the  Privacy Tools for Sharing Research Data project and its many connections to other centers at Harvard. Its mission — “to help enable the collection, analysis, and sharing of personal data for research in social science and other fields while providing privacy for individual subjects” — is up many VRM development alleys, especially around health care.

9. Questions

What if we fail?

What if it turns out that free customers are not more valuable than captive ones for most businesses? That’s been the default belief of big business ever since it was born.

What if the free market on the Net turns out to be “Your choice of captor?” Client-server lends itself to that, although we can work around its inequities with moves like the one proposed in the Research section above.

What if the only VRM implementations that succeed in the marketplace are silo’d and non-substitutable ones? To some degree, that’s what we have with Uber and Lyft. While they are substitutable (as two apps on one phone), we don’t yet have a way to intentcast to multiple ride sharing providers at once, or to keep data that applies to both. Maybe we will in the long run, but so far we don’t.

Apple may be VRooMy with HealthKit and HomeKit, but both still operate within Apples silo. You won’t be able to use them on Android (far as I know, anyway).

And what if the Internet of Things turns out to be a world of silos as well? This too is the default, so far. Phil Windley mocks the Apple of Things and the Google of Things by calling both The Compuserve of Things — and making the case for substitutablility as well.

And what if customers just don’t care? This too is the default: the body at rest that tends to stay at rest. For VRM to fully happen, the whole body needs to be in motion — to move from one Newtonian state to another. It’s doing that in places, but not across the board.

Finally, what if we succeed? VRM is about making a paradigm shift happen. So was  Cluetrain before it. On the plus side, the Net itself lays the infrastructural groundwork for that shift. But the rest is up to us.

Whether we  fail or succeed (or both), there will be plenty to study. And that’s been the idea from the start too.
